Please read these Terms of Service ("Terms") carefully before using the Ziora mobile application ("App") operated by Ziora ("we," "us," or "our"). By using the App, you agree to be bound by these Terms.
By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the App.

When you first use the App, a temporary anonymous account is created. Data associated with anonymous accounts may be lost if you uninstall the App without linking your account.
You may link your account using Google Sign-In or Sign in with Apple to preserve your data. You are responsible for maintaining the security of your account credentials.
You must be at least 13 years old (or the applicable age of consent in your jurisdiction) to use the App.
You retain ownership of the photos you upload ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content within the App for the purpose of providing the service.
You are solely responsible for the User Content you upload. You agree not to upload content that:
We employ automated content screening (including NSFW detection) and user reporting systems to maintain community standards. We reserve the right to remove any User Content that violates these Terms without prior notice.
Photos uploaded to the App are automatically deleted 7 days after upload. We do not guarantee the availability or preservation of any User Content.
If you believe that User Content on the App infringes your copyright, you may submit a notification to our designated copyright agent with the following information:

We will respond to valid notices by removing or disabling access to the allegedly infringing content in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws. Users who repeatedly infringe copyrights may have their accounts terminated.

We offer an optional monthly subscription ("Ad-Free Plan") that removes advertisements from the App.
Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
We may change subscription prices at any time. Price changes will take effect at the start of the next billing period following notice.
These Terms are between you and Ziora only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or the content thereof.
The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.
Ziora is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to provide any maintenance or support services.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Ziora, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including product liability claims, any claim that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the App infringes a third party's intellectual property rights, Ziora, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
The App, including its design, features, code, and branding (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.
The name "Ziora," the Ziora logo, and other brand elements are used by us as our brand. We claim copyright in the Ziora logo and other original brand materials, and we reserve all rights in our brand elements. You may not use them without our prior written permission in any way that is misleading or that suggests endorsement by, affiliation with, or sponsorship by us.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information. Please review our Privacy Policy for details.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
We are not responsible for any User Content uploaded by users. Views expressed in User Content do not represent our views.
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without any liability to you. We are not obligated to maintain, support, or update the App.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App.
Our total liability for all claims related to the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You acknowledge that the free features of the App are provided at no cost. To the maximum extent permitted by law, we shall have no liability whatsoever arising from or related to your use of such free features.
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.
If you encounter User Content that violates these Terms, you may report it through the App. We will review reports and take appropriate action. You may block other users to prevent seeing their content. Blocked users will not be notified.
You may stop using the App and delete your account at any time through the App's settings. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.
You represent and warrant that you are not, and will not become, a member of an organized crime group, an associate of an organized crime group, a related company or association thereof, a corporate extortionist, a social movement advocacy group, a special intelligence violence group, or any other equivalent thereof (collectively, "Anti-Social Forces").
If we determine that you fall under any of the Anti-Social Forces categories, we may immediately terminate your use of the App without prior notice and without any liability.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, wars, terrorism, epidemics, pandemics, power outages, network or infrastructure failures, governmental actions, or failures of third-party services (including cloud hosting, payment processing, and authentication providers).
Before filing any formal legal proceedings, you agree to first contact us at ziora.app.contact@gmail.com and attempt to resolve the dispute informally for at least thirty (30) days.
Any dispute arising out of or relating to these Terms or the App shall be resolved on an individual basis. You agree to waive any right to participate in a class action, collective action, or representative proceeding.
To the maximum extent permitted by law, you waive any right to a jury trial in any legal proceeding arising out of or relating to these Terms or the App.
The App may not be available in all countries or regions. We reserve the right to restrict access to the App in certain jurisdictions in accordance with applicable laws and regulations.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
